1. Introduction

1.1 Acceptance of Terms

By using the Lux Ride platform, including the mobile application, website, and related services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Agreement”). If you do not agree, do not use the Services.

1.2 Amendments & Changes to Terms

Lux Ride reserves the right to modify, update, or change these Terms of Service at any time at its sole discretion. Updates will be posted on our website or notified through the platform. Continued use of the Services constitutes acceptance of the revised Terms.

1.3 Governing Law

This Agreement is governed by Malaysian law. Any disputes arising from or related to this Agreement shall be resolved through arbitration in Kuala Lumpur, Malaysia, in accordance with the rules of the Asian International Arbitration Centre (AIAC).


2. Definitions

  • “Platform” – The Lux Ride mobile application, website, and associated services.
  • “User” – Any individual who uses the Platform to book rides or access services.
  • “Driver Partner” – Independent drivers providing transportation services through the Platform.
  • “Service Fees” – Fees charged by Lux Ride for facilitating ride bookings and payments.

3. Description of Services

3.1 Role of Lux Ride

Lux Ride is a technology platform that connects Users with Driver Partners. Lux Ride does not own, operate, or manage vehicles and is not responsible for the actions of Driver Partners.

3.2 Scope of Services

The Platform facilitates:
✅ Ride-hailing and booking services
✅ Secure payment processing
✅ Trip tracking and expense management


4. User Registration and Account Security

4.1 Registration Requirements

To use the Services, you must:
✔ Be at least 18 years old
✔ Provide accurate and complete information
✔ Maintain and update your account details

4.2 Account Security

You are solely responsible for:
✔ Keeping your account credentials secure
✔ All activities under your account
✔ Immediately notifying Lux Ride of unauthorized access


5. Payments and Fees

5.1 Pricing and Service Fees

Lux Ride reserves the right to adjust ride fares, reservation fees, and other charges dynamically based on demand, route conditions, and operational costs. Pricing updates will be displayed before booking confirmation.

5.2 Cancellation & No-Show Fees

  • Within 2 minutes of booking: No fee
  • After 2 minutes: A cancellation fee determined by the Platform applies
  • No-show penalty: If the User does not board the vehicle within the designated wait time, a no-show fee applies

5.3 Payment Methods

Payments are processed through secure third-party providers via:
✅ Credit/Debit cards
✅ Digital wallets


6. User Responsibilities

6.1 Prohibited Activities

Users must not:
❌ Use the Platform for illegal activities
Impersonate others or provide false identity
Tamper with Platform security
❌ Reverse engineer, decompile, or modify the Platform

6.2 Compliance with Laws

Users must comply with all applicable laws and regulations when using the Platform.


7. Third-Party Interactions

7.1 Driver Partners

Lux Ride does not assume responsibility for the actions or conduct of Driver Partners. Any disputes must be resolved directly with the Driver Partner.

7.2 Advertising

Lux Ride may display advertisements. The company is not responsible for the accuracy of ad content.


8. Intellectual Property

All trademarks, logos, and software in the Platform belong to Lux Ride. Users receive a limited, non-exclusive license for personal, non-commercial use only.


9. Limitation of Liability

9.1 Disclaimer of Warranties

The Platform is provided “as is” without warranties regarding:
❌ Service availability
❌ Information accuracy
❌ Driver Partner conduct

9.2 Exclusion of Liability

Lux Ride is not liable for:
❌ Indirect or incidental damages
❌ Disputes between Users and Driver Partners
❌ Losses from service unavailability


10. Indemnification

Users agree to indemnify and hold Lux Ride harmless against claims arising from:
User misconduct
Violation of these Terms
Interactions with Driver Partners


11. Account Suspension & Termination

11.1 User Termination

Users may terminate their account at any time via the Platform.

11.2 Lux Ride Termination

Lux Ride may suspend, restrict, or permanently terminate an account for:
Fraudulent activity
Multiple cancellations or no-shows
Abuse of drivers or Platform
Attempting to bypass service fees

Lux Ride reserves the right to take legal action against fraudulent users.


12. Dispute Resolution

12.1 Governing Law

This Agreement is governed by Malaysian law.

12.2 Arbitration

Any disputes shall be resolved through binding arbitration in Kuala Lumpur, Malaysia, in accordance with AIAC rules.


13. Force Majeure

Lux Ride is not liable for service failures due to:
Government actions or restrictions
Natural disasters, pandemics, or extreme weather
Labor strikes, riots, or civil unrest
Technical failures or cyberattacks

Lux Ride reserves the right to delay, reschedule, or cancel rides without liability in such cases.


14. Changes to Terms of Service

Lux Ride reserves the full right to modify, amend, or update these Terms of Service at any time without prior notice. It is the User’s responsibility to review the Terms periodically for updates. Continued use of the Platform after modifications constitutes acceptance of the revised Terms.


15. Miscellaneous

15.1 Entire Agreement

These Terms constitute the entire agreement between the User and Lux Ride.

15.2 Severability

If any provision is invalid, it shall be severed, and the remaining Terms will continue in effect.

15.3 Assignment

Users may not assign their rights under these Terms without Lux Ride’s written consent.

Driver/Partner Terms of Use

Welcome to Lux Ride Malaysia by SKYELITE VENTURES ONLINE HUB SDN. BHD (“we,” “our,” or “us”). These Terms of Use govern your participation as an e-hailing driver or partner on our platform. By registering, you agree to comply with these terms. If you do not agree, you must stop using our services immediately.


1. Eligibility & Registration

1.1 You must be at least 21 years old and hold a valid Malaysian Competent Driving License (CDL).
1.2 You must own or have access to a registered, roadworthy vehicle that meets our e-hailing standards.
1.3 You must pass background checks, including a driving record and criminal history check.
1.4 You must provide valid e-hailing insurance coverage.
1.5 You must obtain a valid Public Service Vehicle (PSV) license issued by JPJ.
1.6 You must ensure that all permits, road tax, and e-hailing requirements are kept up to date.


2. Driver/Partner Responsibilities

2.1 Compliance with Laws

  • You must comply with all Malaysian transport laws and JPJ & APAD (Agensi Pengangkutan Awam Darat) regulations.
  • You must renew and maintain all necessary licenses, permits, and insurance policies.

2.2 Professional Conduct & Appearance

  • You must always act professionally, respectfully, and courteously toward passengers.
  • You must wear clean and appropriate clothing at all times, including:
    • Collared shirts or professional attire
    • Long pants (no shorts allowed)
    • Closed shoes (slippers and sandals are strictly prohibited)
  • You must maintain good personal hygiene to ensure a pleasant experience for passengers.
  • If a passenger complains about poor hygiene, inappropriate clothing, or unprofessional conduct, we reserve the right to suspend or terminate your account immediately.

2.3 Vehicle Standards

  • Your vehicle must always be clean, well-maintained, and free from unpleasant odors.
  • Smoking, vaping, or eating in the vehicle during service is strictly prohibited.
  • Modifications that affect passenger safety or comfort (e.g., excessive window tint, loud music, unsafe decorations) are not allowed.

2.4 Behavior & Service Standards

  • You must not refuse rides based on race, gender, disability, or any other discriminatory reason.
  • You must not engage in fraudulent activities, including fake bookings, account manipulation, or fare tampering.
  • You must not operate under the influence of alcohol, drugs, or any substances that impair driving.
  • You must not engage in verbal abuse, harassment, or inappropriate behavior toward passengers.

3. Fares, Payments & Fees

3.1 Fares are calculated based on distance, time, and demand, and may be subject to platform commission and service fees.
3.2 Commission and service fees will be deducted from your earnings automatically.
3.3 Payouts will be processed according to our payment schedule.
3.4 You must not request additional cash payments from passengers outside the app.


4. Suspension & Termination of Account

4.1 Grounds for Suspension or Termination

Your account may be suspended or terminated if you:

  • Violate Malaysian transport laws or company policies.
  • Receive multiple passenger complaints about conduct, service quality, or vehicle conditions.
  • Operate without valid licenses, insurance, or permits.
  • Engage in dangerous or reckless driving behavior, including repeated traffic violations.
  • Refuse to accept rides based on discriminatory reasons.
  • Manipulate fares, create fake bookings, or engage in fraudulent activities.
  • Verbally or physically abuse passengers or company staff.

4.2 Company Discretion

  • The company reserves the right to suspend or terminate driver accounts without prior notice.
  • All decisions regarding suspension or termination are final and cannot be disputed.
  • The company is not liable for any financial losses due to suspension or termination.

5. No Employment Relationship

5.1 The driver is considered an independent contractor, not an employee of the company.
5.2 The company does not guarantee any fixed earnings, benefits, or employment security.
5.3 The company is not responsible for tax obligations, EPF, SOCSO, or any statutory deductions for drivers.


6. No Legal Claims Against the Company

By using our platform, you waive any legal claims against the company, including but not limited to:

  • Suspension or termination of your account.
  • Loss of earnings due to deactivation.
  • Complaints filed by passengers.

7. Intellectual Property

7.1 The company’s name, logo, and branding cannot be used without written permission.
7.2 Drivers cannot misrepresent themselves as employees of the company.


8. Right to Modify Fees & Commission

8.1 The company reserves the right to change fares, commissions, and service fees at any time.
8.2 Drivers will be notified of any fare or commission adjustments through the app or email.


9. Non-Compete & Confidentiality

9.1 Drivers cannot promote competing e-hailing services while using our platform.
9.2 Drivers cannot share passenger data with third parties or competitors.


10. Force Majeure Clause

10.1 The company is not liable for service disruptions caused by:

  • Natural disasters, floods, fires, or pandemics.
  • Government actions, regulations, or restrictions.
  • Technical failures, cyberattacks, or system outages.

11. Complaints & Dispute Resolution

11.1 Any disputes between drivers and passengers must be reported to the company.
11.2 The company will review disputes at its discretion, and its decision shall be final.


12. Amendments to Terms

12.1 The company reserves the right to update or modify these terms at any time.
12.2 Continued use of the platform after changes means you accept the revised terms.

1. General Amendments

Lux Ride reserves the right to update, modify, or remove any policies, features, or terms related to the platform and services at any time without prior notice. Any changes will be published on the platform, and continued use of Lux Ride after the changes indicates acceptance.

2. Service Suspension & Account Deactivation

Lux Ride may suspend or permanently deactivate a user’s or driver’s account for:

  • Repeated policy violations (e.g., ride cancellations, no-shows, misuse of the platform).
  • Fraudulent activities, including false complaints, fake bookings, and unauthorized transactions.
  • Misconduct or harassment toward passengers, drivers, or Lux Ride representatives.
  • Security concerns such as unauthorized access or hacking attempts.
  • Abuse of promotions, referral programs, or system loopholes.
  • Failure to meet compliance standards required by Malaysian laws or Lux Ride’s internal policies.

Lux Ride will review cases and may, at its sole discretion, provide an appeal process. However, Lux Ride holds the right to enforce immediate suspensions without notice if deemed necessary.

3. Limitation of Liability

Lux Ride is a technology intermediary and is not responsible for:

  • Accidents, damages, or losses during trips.
  • Driver or passenger misconduct.
  • Delays due to traffic, weather, or unforeseen circumstances.
  • Third-party services, including payment gateways or external service providers.

4. Refund & Cancellation Policy

  • Ride Cancellations: Users may be charged a cancellation fee based on the cancellation timing.
  • No-Show Fees: If the passenger does not board within the waiting period, a fee will apply.
  • Non-Refundable Payments: All promotional credits, reservation fees, and service fees are non-refundable.

5. Promotions & Discounts

  • Lux Ride reserves the right to change, cancel, or suspend any promotions at its sole discretion.
  • Discount eligibility is subject to verification and may be revoked if abuse is detected.
  • Referral rewards are only valid if the referred user completes an eligible ride.

6. Force Majeure Clause

Lux Ride is not liable for any failure in providing services due to events beyond its control, including but not limited to:

  • Natural disasters, pandemics, or severe weather conditions.
  • Government actions, strikes, or legal restrictions.
  • System failures, cyberattacks, or technical disruptions.

7. Data Retention & Security

  • User data will be stored securely and retained only for as long as necessary for business and legal purposes.
  • Lux Ride has no obligation to retain or provide access to ride history, transactions, or chat logs beyond the required period.
  • Any unauthorized attempts to extract, misuse, or manipulate platform data will result in legal action.

8. Third-Party Services & Advertisements

  • Lux Ride may include third-party advertisements and links on the platform.
  • Lux Ride is not responsible for the accuracy, reliability, or security of third-party services.
  • Engaging with any third-party promotions is at the user’s own risk.

9. Compliance with Laws

All users and drivers must comply with local laws and regulations, including:

  • Traffic and vehicle safety laws.
  • Tax compliance and reporting obligations (for driver partners).
  • Data privacy laws related to passenger information handling.

Users and Driver Partners are required to make reasonable efforts to resolve any disputes or grievances directly with Lux Ride through its designated dispute resolution channels before initiating any legal proceedings. Lux Ride reserves the right to propose mediation or alternative dispute resolution methods to facilitate an amicable settlement. Engaging in good-faith discussions prior to litigation is encouraged to ensure a fair and efficient resolution for all parties involved.
